The court has refused to hear the petition demanding an investigation through the Central Bureau of Investigation (CBI) in the Disha Salian death case. Justice Sandesh Patil of the Mumbai High Court clearly refused to hear this petition, stating that there is no reason to intervene anew in this matter. This decision of the court is considered to have once again brought judicial stability to this sensitive and discussed case. Disha Salian was the former manager of Bollywood actor Sushant Singh Rajput. In June 2020, she died after falling from a building in the Malad area of Mumbai. After this incident, the Mumbai Police initially investigated and recorded it as an accidental death.
However, after some time, various suspicions and allegations regarding this matter were expressed through social media as well as political circles. As a result, this matter remained consistently in discussion. Meanwhile, a petition demanding a CBI inquiry into the Disha Salian death case was filed in the Mumbai High Court. The petition claimed that the investigation in the case was incomplete and that an independent central agency investigation was necessary to bring out the truth. It was also alleged in the petition that some important aspects of the case were suppressed.
However, the court clearly refused to hear this petition. Justice Sandesh Patil observed that an investigation has already been conducted in this matter, and no new concrete evidence or facts have emerged. The court clarified that it would not be appropriate to order a re-investigation based solely on suspicion or public pressure. The court also noted that according to the reports submitted by the investigating agencies, although this death is unfortunate, it has not been proven to be of a criminal nature. Therefore, the judges stated that the court does not have sufficient grounds to issue a stringent order like a CBI inquiry.
After this decision, it appears that the judicial curtain has once again fallen on the Disha Salian death case. However, some organizations and individuals are still raising questions about this case. On the other hand, welcoming the court's decision, some legal experts have expressed that attempts to misuse the law to reopen the case have been curbed. This verdict has sent a clear message from the High Court that the direction of an investigation cannot be changed based solely on public sentiment or political pressure. The court's stance has been highlighted that it is not appropriate to order a CBI inquiry without solid evidence and legal basis. This decision in the Disha Salian death case is expected to serve as a guide for such petitions in the future.
