He stated that a separate set of regulations will be prepared to make the city turban-free and ensure the proper and fair redevelopment of turban buildings.

There are more than 19,000 cess/pagdi buildings in Mumbai. Many of these buildings are in a dilapidated condition, and some have caused loss of life due to collapses. Approximately 13,000 buildings are awaiting redevelopment. Redevelopment was hindered due to tenants being protected by the rent control law. Redevelopment was stalled due to agreements between landlords and tenants, issues of rights, and court cases reaching up to 28,000.

According to the new regulations, tenants will be given FSI equivalent to the area of the house in their possession. Homeowners will receive basic FSI in exchange for their ownership rights. Incentive FSI will be provided for the free redevelopment of pagdi tenants. If the full FSI cannot be used in the project, the remaining FSI will be made available in the form of TDR. The existing provisions of 33(7) and 33(9) will also remain in place.

Additional fast-track courts will be established with the permission of the High Court to resolve pending cases between tenants and homeowners. The government has set a target to resolve all cases within the next three years.

This decision will pave the way for millions of Mumbaikars living in Pagdi buildings to get rightful homes. The condition of dilapidated and dangerous buildings will improve, and redevelopment will gain significant momentum. “The Mahayuti government is making decisions in the interest of the common people. This scheme will prove to be a boon for Mumbai,” said Shinde.
