According to Ulhas Bapat, if a public representative is sentenced to more than two years, he becomes disqualified from that moment. In such a situation, the concerned person cannot remain in the ministerial position. Previously, there was a separate provision only for ministers, but it has been annulled by the Supreme Court, and now this rule applies equally to all public representatives.

However, there is one important legal possibility in all this. If the High Court grants a temporary stay order on the appeal filed by Manikrao Kokate, his membership can remain intact and there is also a possibility of retaining his ministerial position, Ulhas Bapat clarified.
